Why it is important to read the Terms Of Service?

When signing up for web hosting services, please be sure to actually read the terms and not just check the box saying, “Yes, I agree to the terms of service.” Many web-hosting companies have not only a Terms of Service (TOS) agreement but also an Acceptable Usage Policy (AUP) agreement. When you are reading these agreements it may just sound like a lot of legal jargon to you, but you should pay attention to what the agreements say.

Often in TOS agreements, you will see that the web hosting companies state that they reserve the right to modify the terms as they see fit. Some companies will actually state that they may do this without sending you prior notice. This is something you may not want to agree to. Some agreements will say they can make changes at anytime but if you do not agree to the changes you can terminate your service. And other companies are very fair in that they will provide you with a notice before changing their Terms of Service.


Most web hosts state in their Terms of Service agreements that you cannot place a website with content that is sexual in nature on their servers. The majority of web hosts often prohibit sending spam from your website. The problem with this is definitions of spam often vary. How can you be sure how this web host defines spam if it is not clearly stated in their TOS or AUP agreements? If someone complains to your web host that you sent spam they may stand by that person or company and not you!


Many web-hosting companies offer 99.9% uptime guarantees. This sounds great right? Your we bsite is guaranteed to be up 999% of the time or more. However it is important to read the Terms of Service there may be exceptions to this guarantee. Also read carefully to find out what you receive if your website is not up at least 99.9% of the time. Some hosting companies will state in their TOS that if they are making upgrades to hardware or software that this will not count as downtime. If your website is down more than 0.01% of the time, you may find you simply do not have to pay for the time your website was done. This does you little good if you run a business website and lost clients or sales due to downtime.

The point is, you should read Terms of Service agreements and Acceptable Usage Policies before signing up for service. Make sure you understand the terms of the agreements and that you can agree to and live with these terms.
